A three-judge panel from the Fourth Circuit Court of Appeals vacated a preliminary injection order Thursday that had allowed 23XI Racing and Front Row Motorsports to compete as chartered teams — and receive the financial benefits as a chartered team.

Denny Hamlin says he is unfazed that a three-judge federal appellate panel vacated an injunction that required NASCAR to recognize 23XI, which he owns with Michael Jordan, and Front Row as chartered teams as part of an antitrust lawsuit.

During the May hearing, judges had warned the teams their claim came across as “having your cake and eating it, too.”
