The Trump administration is moving ahead with its plan to kill New York City’s congestion pricing – a controversial tolling program designed to help raise millions in critical infrastructure funding and decrease traffic in Manhattan’s most congested zones.

The president made his power to shut down the tolling system sound absolute. But legal experts say the law may not be in his favor.

Transportation Secretary Sean Duffy says he has rescinded approval of the tolling.

The U.S. Department of Transportation said the Federal Highway Administration has "terminated approval" of New York City's congestion pricing plan.

Duffy did not give a time frame for trying to shut down congestion pricing, saying only that federal officials would contact the state to "discuss the orderly cessation of toll operations." MTA CEO Janno Lieber said tolling would "continue notwithstanding this baseless effort to snatch those benefits away."

The federal waiver granted to the state of New York by the Department of Transportation has been rescinded as of Wednesday.
