In 2021, a three-judge panel of the 11th Circuit ruled for Adams on the equal-protection claim over the strong dissent of one judge. But the full 11th Circuit granted rehearing in the case.

On the federal level, the 2023 Restroom Access Act would mandate all U.S. retailers to allow people with bowel conditions access to an employee restroom, if there is no public bathroom available.

Rules about restroom access in restaurants vary by state, city and county. New York requires restroom access for customers at food establishments with 20 or more seats.
